CAC to Release the draft of New Rules on AI-generated Content.

On April 11, 2023, the Cyberspace Administration of China (“CAC”) released the Soliciting Public Opinions on the Measures for the Administration of Artificial Intelligence Generated Content (“Measures”) (Draft for Soliciting Opinions)”, and the deadline for feedback is May 10, 2023.
The Measures contain total 21 articles and are applicable to the Artificial Intelligence Generated Content (“AIGC”) products that provide services to the public within China, which also highlight the restrictions on ideology, intellectual property, information security, fair competition, and other aspects. The Measures specify that the entities using AIGC to provide services shall bear the responsibility of content producers, and those involving personal information shall also bear the legal responsibility of personal information processors; Before providing services, a security assessment should be submitted to the national cyberspace administrative department and the registration for algorithm, the amendments therefor, and the registration cancellation procedures shall be completed. The Measures also emphasize that service providers shall not illegally retain the input information which may infer the identity of users, shall not draw portraits based on input information and usage of the users, and shall not provide users’ input information to others; It is not allowed to generate any content with discriminatory based on the users’ race, nationality, gender, etc.
