Guidelines on Compliance of Internet Companies in Question and Cyber Legislation.

On April 18, 2023, the Supreme People’s Procuratorate (“SPP”) released the Guidelines for Procuratorial Organs on Strengthening Law-based Governance of Cyberspace in the New Era (the “Guidelines”).
The Guidelines have 21 articles, focusing on ideological security, network system and data security, digital economy, and protection of minors’ rights and interests. The Guidelines require to fully playing the functions of justice in handling cases.
The Guidelines particularly stress that efforts should be made to promote compliance of Internet companies in question, as well as the formulation and revision of the pertinent laws, regulations and data compliance guidelines.
The Guidelines urge to develop and improve the prosecution criteria, evidence collection rules, evidence review requirements and proof rules, as well as the methods for the disposal of assets involved and to advance the formulation and improvement of the judicial rules for the trials of Internet-related civil and commercial cases.
